While District Judge Mark Davidson's temporary injunction against The Penthouse Club isn't exactly apocalyptic, it is getting attention from various media outlets, with, as one might expect, varying levels of snark.
Judge Davidson ruled against the club yesterday, saying it violated a 1997 Houston City ordinance that regulates sexually oriented businesses. A trial is set for Oct. 27. Attorney Patrick Zummo told the Chronicle, "This particular club became the first one because they sued us while the federal appeals were still going on ... We realized they deserved to be the first one [to go after]."
The city sent out 119 letters to other businesses and will presumably prosecute.
The club has a month and a half to come up with a better defense than to argue, as they did in Davidson's courtroom, that they're not a sexually oriented business.
