OK, this is unreal: Fresh off yet another courtroom defeat in their quest to disqualify challenger Wendy Davis, state Sen. Kim Brimer's campaign is threatening additional litigation. H/T Quorum Report:
With the court ruling today, we will focus on winning this election and defeating our ineligible opponent at the ballot box leaving the question of eligibility to be determined by action taken after the election.
Two things: Three separate courts have looked at challenges against Davis' eligibility as a candidate -- and none of them ruled against her. So, to simply refer to her as an "ineligible opponent" comes very close to flat-out lying. It's definitely reckless and misleading.
But let's hit at the ulterior motive here. The Brimer camp, including high-dollar consultant Bryan Eppstein--- must realize that Davis is a serious threat and they clearly think that by raising questions about her eligibility -- even after the courts have spoken -- will erode her support. I think that's a bad miscalculation and that all Brimer's challenges against his opponent have done is give her free publicity and stir up her base. We'll know for sure in less than a month.

Correction: The Davis campaign reports raising an astonishing $1 million in the last quarter since the beginning of the campaign and have outraised the incumbent by nearly $800,000, $70,000 in the last quarter. That mistake is on my end. The press release is here:

Most recent filing shows Davis outraised Brimer since July in race for SD10 seat
Fort Worth, TX - The Wendy Davis campaign surpassed $1 million dollars in total fundraising on the most recent Texas Ethics Commission finance report, and outraised incumbent Kim Brimer for the reporting period with $287,957.45.
Davis pointed to her fundraising advantage as a sign of the growing momentum her campaign has carried into the final 30 days of the race.
"I'm incredibly grateful to the huge number of people who have contributed and volunteered to help my campaign. Our success is a clear indication that Tarrant County families are looking for an honest and transparent leader who puts them first in the senate," Davis said.
Political observers around the state have called the State Senate District 10 contest "the race to watch" in Texas. In 20 years in the legislature, Kim Brimer has never faced a challenger as strong or well-financed as Wendy Davis, so his record of self-dealing and ethical lapses are being exposed to many for the first time by this competitive campaign.
"Kim Brimer has unsuccessfully attempted to use the courts to avoid facing the strong challenge coming from Wendy Davis, but our well-financed campaign will work to make sure Brimer's record of enriching himself at taxpayers' expense comes to light," Davis campaign spokesman Bernie Scheffler said.
Brimer has been in the news recently for multiple ethics problems, including a scheme to purchase himself a luxury condo with campaign donations and an attempt to force taxpayers to pick up the tab for his own personal loans which he refused to pay, even though he owned a successful insurance company and was drawing a legislator's salary at the time.
