Cement company questions governments' 'green' preferences

DALLAS -- A cement company has file a federal lawsuit alleging that Tarrant County and the cities of Fort Worth and Arlington, along with other area governments, violate state laws by giving preference during bidding to companies using cement made using environmentally friendly methods.


The firm in question is Ash Grove Cement Co., which has a plant in Midlothian.

As the government has an inherent duty to protect the public\' coffers from wasteful spending, would this policy giving preference to those who profess to use environmentally-friendly materials fall under that duty? Such materials and practices have proven, so far, to be more expensive. This lawsuit, if given the proper platform, could affect municipal bidding practices nationwide. This suit is pretty comprehensive and lists the actual resolutions from the named defendants as part of its exhibits with its claim that it violates Texas law, So are these very resolutions going to part of the contest? It appears so at this point.
