KBTX-TV and the Bryan-College Station Eagle newspaper are going to the Texas attorney general to try to obtain video of Hearne Mayor Milton Johnson's Dec. 20 run-in with police.
Johnson was pulled over that day for an apparent traffic violation, and KBTX says it has learned that Johnson swore at the officers. Johnson has since apologized, the Eagle reported.
The press has sought access to the police's dash-camera video of the stop, but City Attorney Bryan Russ is so convinced that the city can withhold the tape that his office "will not be seeking an opinion from the Texas Attorney General," even though Johnson's case has been all but adjudicated -- he pleaded no contest, gets 90 days' deferred adjudication and must pay a $200 fine.
It'll be interesting to see whether the AG will allow the city to sit on the tape after the 90 days, when the case against Johnson has completely run its course in the courts and no one can claim it is part of a pending investigation.
