Supreme Court could decide in Nov. whether to hear Obamacare challenge from states

The Supreme Court could decide in a private conference scheduled for Nov. 10 to hear the challenge of Texas and 25 other states to the constitutionality of the Patient Protection and Affordable Care Act.

Politico is reporting the Supreme Court would likely make that private decision public on Nov. 14 or decide on the fate of the health care law challenge sometime later.

Texas Attorney General Greg Abbott has been outspoken on behalf of the 26 states in his contention that the law forces Americans to buy insurance in violation of the Constitution. However, Politico says President Obama’s administration is also anxious to have the high court rule on one of the centerpieces of his administration.

Other petitioners include the National Federation of Independent Business, Liberty University and the Thomas More Law Center. The state of Virginia, which is also asking that its challenge to the law be heard, has not yet received a reply from the Justice Department.

The cases could be heard separately, or they could be combined.
