Following the legally dubious suspension of two officials in the La Marque school district, the Galveston Daily News today in an editorial urges the state to get involved in the personnel debacle.
The school board there on Monday suspended the superintendent and the police chief of the district during a public meeting, although no such item was on the agenda for consideration.
The editorial notes:
The editorial notes:
The public was given no warning about those actions. Claims to the contrary are laughable. One trustee, Joe Cantu, left the meeting, knowing the agenda included no further votes. If a school board member doesn’t know a vote is coming, how is the public supposed to know?
And, of course, the Texas Open Meetings Act clearly states that ordinary residents have a right to know about important business in advance of a meeting. In Cox Enterprises Inc. v. Board of Trustees, the Texas Supreme Court ruled the Austin school district specifically had to inform the public in advance about an action involving a superintendent.
The district’s board of trustees has announced a special meeting on Monday, with the agenda specifically outlining its consideration of the actions against the chief and superintendent.
