The state Attorney General’s office has ruled that the Texas City Police Department doesn't have to make public a complaint against the city’s police chief.
The memorandum ruling sides with the city’s contention that release of the complaint against Police Chief Robert Burby would interfere with a pending case or police work.
It cites this exception for release of records in state government code.

Under the state’s open records law, the Daily News in Galveston had requested the complaint against Burby in connection with the suspension of police officer Darren A. Allen.
Allen was charged in November with two misdemeanors related to an incident with a fellow officer. He was suspended indefinitely in December.
His state certification is here and shows that Allen worked for the University of Houston Department of Public Safety for eight months before moving to the Texas City department in November 2007.
